There may very well be some prohibition against competing with ATHM, but I can't imagine reserving a name could be construed as "competing.

I can imagine, however, a court supporting the non-compete clauses even in bankruptcy in order to protect the assets of ATHM. A true catch-22... ATHM stops operations, blocks access to customers to preserve assets, watches as that asset goes up in smoke.
