intel defines the rules and hence have an unfair advantage. May I dare to remind you that original IBM deal with intel for cpus had a condition that amd would license the technology. Now, no one forced intel into that deal but intel would not be what they are right now if not for that deal.
Also dare I remind you that it is a fixed cost business. If intel's margins are sufficiently high then there is no problem but price war forces amd to aim at higher market share.
