Try withholding judgement until the facts are in.

Sorry...but I'm afraid that I can't be quite as nonjudgmental as you. I don't live in Berkeley or Marin County!

The fact that he was fighting against Americans, trained in a bin Ladin camp, and was quoted as saying "that he supported and supports the attacks of September 11". Those facts alone allow me to make a judgement. Even if he was as you said "drawn into the Taliban" as other kids might be drawn into a cult, he is still responsible for his actions. We are at war, and he was found fighting for the wrong side. (I don't believe he was an undercover CIA operative.)

There is currently a poll on CNN.com where the question "Should the American who fought with the Taliban be tried for treason?" is asked. Right now 84% of those who voted, said "yes".

I do feel sorry for his parents, as I'm sure it must be difficult to deal with a son who seems to have "lost his way."
