<< [al-Baqarah 2:228] Divorced women shall wait concerning themselves for three monthly periods. Nor is it lawful for them to hide what God Hath created in their wombs, if they have faith in God and the Last Day. And their husbands have the better right to take them back in that period, if they wish for reconciliation. And women shall have rights similar to the rights against them, according to what is equitable; but men have a degree (of advantage) over them. And God is Exalted in Power, Wise. >>
This verse simply addresses what should happen after both husband and wife choose to get a divorce. The divorced woman has to wait 3 months before remarrying to make sure she is not pregnant by her prior husband. If she is pregnant but didn't wait 3 months to remarry, then there may be a question as to who the father of the child is.
Now, during that 3 month period, it is okay for the couple to reconcile and to get back together. The reconciliation must be mutual and cannot be forced upon either; a divorced wife has the right to refuse resumption of a marriage if the husband asks for the divorce to be rescinded. Also, since it is the husband who is responsible for the maintenance of the family, the first option to rescind a provisional divorce rests with him.
<< [an-Nisa' 4:11] Allah chargeth you concerning (the provision for) your children: to the male the equivalent of the portion of two females, and if there be women more than two, then theirs is two-thirds of the inheritance, and if there be one (only) then the half. >>
The rules of inheritance are simple. Men who inherit are materially responsible for both their own family as well as the well being of the females who inherit. Therefore, the men get more of the inheritance. |
