He's more than an enemy soldier and that's the point. Here is a man who took up arms against his own country. The stated purposes pre-9/11/01 may have been different for the Taliban but post our attack on them, it changed. Mr. Walker did not turn himself in and swear allegance to the US - instead he stayed with the Taliban against the US.

He's more than a POW. He's a traitor and should suffer the penalties. POWs are interrogated, perhaps tortured, and then released when the hostilities are over. That won't happen to Walker as a traitor. I personally believe he's a very misguided young man who really didn't consider all the way through what he was doing. But that does not excuse his behavior. The law assumes that by 20, you know what you're doing and unless he can show some serious mental defect (other than the point made by the medical community that he's either an asshole or a douchbag :)), he's is deep do do.
