NEW YORK--(BUSINESS WIRE)--Dec. 6, 2001--The Plaintiffs' Executive Committee in In re: Initial Public Offering Securities Litigation, 21 MC 92 (SAS) announces that a class action lawsuit was filed on behalf of purchasers of the securities of Variagenics, Inc. (``Variagenics'' or the ``Company'') (NASDAQ: VGNX - news), between July 21, 2000 and December 6, 2000, inclusive.

Without wishing to imply anything as to the merits of this particular case, is there such a thing in US law as 'frivolous & vexatious litigation' ? If so, would a class action suit against various firms of lawyers be possible ? Plaintiffs could be just about anyone who invests in publicly quoted companies, or indeed, the companies themselves. Damages claimed could include compensation for increased legal & insurance costs as a result of the potential defendants' unsavoury actions.

Any under-occupied lawyers out there ?
