I guess I'm just a simple guy.

I figure that since we're at war, I would treat any US citizen providing aid and comfort to the enemy as a traitor (eg: John Walker), trying them on charges of treason and/or spying.

Note: During peacetime, the charge is espionage, which is a criminal offense. But during war.. it's called spying and is considered a capital offense (death by hanging).

For non-US citizens and resident aliens who are found to be involved with the enemy, I would also try them as wartime spies. And I would try them under these statutes even if they weren't personally involved in the Sept 11th attacks, but were just part of the overall terrorist organization. They are still part of a covert group whose aim is the destruction of the United States, and thus declared themselves to be our enemies by fact of the people they have officially associated themselves with. The trick will be in proving that association.

Basically, being involved in a terrorist organization that has declared war on the US, gives us all the authority we require to detain them, since they are not US citizens.
We could have (should have?) rounded these folks up back in 1993 when the first attack on the WTC occurred, and certainly when Bin Laden proclaimed they were at war with the US.

This is clearly an enemy that uses covert operatives to conduct their military operations against the US. They don't have uniforms, nor do they carry ID cards. Just classic guerilla warfare... And anyone who willingly gives them aid and support to carry out their attacks have stated they are also enemies of the US.

Like I said... I guess I'm just a simple guy.
