The difference between what FDR faced and what Ashcroft faces, today, is akin to the difference between owning 100 shares of AMAT and owning the whole company.

Ashcroft is making sure that nobody is really privy to what he is doing, not even the Congress. Under these circumstances judgements must fall back on the fact that he is scum and should not be the Attorney General.
