People have been executed for far less than what John Walker is accused of, namely being part of a terrorist organization.
As for taking up arms, what do you think he was doing?
Hmm, I really have no views on this case at the moment. I'm waiting to hear some of the details. But my guess is that much of the debate will be about how much of "being a part of a terrorist organization" is enough. Moreover, I think he was part of the Taliban, not part of Osama bin Laden's crew, though, again, I'm not certain. If I'm right, however, I don't think we (the US govt) asserted that every member of the Taliban was a part of a terrorist organization.
As for whether he was taking up arms against the US, I said, in the original post, that it looked as if that was the case, but I should have said, if I did not, that we would have to wait for an investigation to see.
On that score, you run right up against my concern about an investigation. If it's fair, run according to accepted judicial principles, it's much easier for me to accept the judgment.
