"Are you saying that you agree that ANY AND ALL CRITICISM OF OUR GOVERNMENT is 'siding with terrorists'?"

Absolutely NOT. I am saying that when our governement is criticized for no reason during a time of war it is "siding with the terrorists". Maybe inadverdent siding, but siding none the less.

"Who 'besmirched' anyone?"

When you question the motives of our leaders with no basis it "besmirches" the U.S. If the criticisms were valid I would have no problem.

"Open debate and free-wheeling constructive criticism is supposed to be part of that"

I agree. But stating that our military will not give a fair trial with evidence to the contrary is not what I would call "constructive". Would you agree that destructive criticism is not good? If so, I would like to see the examples of constructive criticism regarding the "trashing" of our constitution. Again, I don't feel it has been trashed. If you can show me that it has been I will switch to your side.

"It is certainly an appropriate criticism to say that excluding the Judiciary from trials, Congress from constitutionally mandated oversight"

It is not. Military tribunals make sense in a time of war and the allegation about mandated oversight is false. I view these as destructive critcism. Curious why you think the tribunals are unfair for war criminals and will debate the issue if you would like. Bring a few hundred to a few thousand foriegn terrorists into our court system seems like a bad idea to me. Particularly when people like OJ Simpson can get away with murder WHILE costing the US taxpayers untold MILLIONS. I will accept the lenient system for our citizens, but not war criminals from another country.

"They relied upon physical attacks"

Sounds like you are describing the attacks of 9-11-01. The manual explained the EXTREME importance to them for communicating in code through their lawyers and taking advantage of attorney client privilege to cause harm to Americans. Ascroft explained how in limited circumstances we will be able to eavesdrop but not before telling the criminal and his lawyer, the info can have no bearing on the trial, and the one listening has nothing to do with the case. But IF they use it to harm Americans (as their manual instructs very specifically) we will stop it.

"Not one of our vaunted constitutional freedoms occasioned this attack"

Again you look backwards at one event instead of forwards towards any and all possible events. Do you think the particular attack on 9-11 is the only kind they will consider in the future? Is it the only type of attack we should prepare for? That is what it LOOKS LIKE you are saying.

"Pretty funny way to run a railroad, by shooting yourself in the same foot your enemies want to shoot you in...."

Again - point out what freedoms are being trashed so we can see if your (and Leahy's and Kennedy's and Feingold's) criticisms are CONSTRUCTIVE or DESTRUCTIVE. Me and John Ashcroft feel they are DESTRUCTIVE and I am glad that he is not too much of a PC coward to say so to their faces.

"because the members of the committee are idiots"

Hey, maybe we aren't too far off after all.

Your points are all interesting in theory, but I really need to see the specific complaints to see their value. From everything I have seen and heard and read they look like partisan whining and destructive criticism of some fine Americans that are doing their damn best to protect us. I am very secure in our retention of the most awesome set if civili liberties on the planet.
