If it's a war, then Osama and Omar aren't terrorists
they are leaders of a competing national power. Sure, they destroyed the WTC and lots of civilians


it doesn't matter...O&O have operated outside of the accepted constraints. to achieve international status as a war participant and to get the protection afforded by that status, one must abide by the international war conventions.

there is much precedent for trying not only war criminals but also spies and terrorists for actions in war zones.

assuming capture...
if they are terrorists, they will be tried for murdering 4,000 folks.
if they are POWs, they will be tried for murdering 4,000 non-combatants.
