Your contention that our constitution applies in the same way to everyone on our shores is legally wrong. Don't you think that the courts have dealt with such issues sometime in our history? To make a broad brush statement that the meaning of our constitution is extraneous to the document and depends on social conditions at the time it was written makes no legal sense. What about amendments? I do not for the life of me know why you insist on making the assumptions about the constitution that you make. Your position is not even an argument. It is like saying there is zinc on the moon because the ocean is blue. (which it is not by the way).
