Goldman Faces Japan Penalty for Failing to Report Short Selling

Tokyo, Dec. 19 (Bloomberg) -- Goldman Sachs Group Inc. faces
disciplinary action in Japan for the second time this year as
regulators said the brokerage violated Japanese securities law by
failing to report its short-selling to the Tokyo Stock Exchange.

The Securities and Exchange Surveillance Commission
recommended the Financial Services Agency take a disciplinary
action against Goldman Sachs for failing to notify the exchange
after it sold borrowed shares in expectation it could later buy
them back at a lower price, SESC senior official Kimito Nakae said
in a press briefing
