Harlan, I just got off the phone with my A.G. Edwards broker and he gave me a couple of points to consider before I make any decisions about getting into ODP:

1) He stated that it is very uncommon that the FTC would expect to lose when it is trying to prevent mergers from happening. He said we have a 80-20 chance that the FTC will win and prevent the merger from happening.

2) A.G. Edwards currently has an AGGRESSIVE SELL rating on ODP and identifies anyone who is buying the stock long is considered a speculator.

3) The only way that SPLS and ODP may approve the merger is that if they can identify a flaw in the FTC's procedures pertaining to these merger talks. Do you know when the last time the FTC screwed up in its procedures? This is the reason a commission was established in the first place. The court will decide that they properly followed procedures or not. If they did, ODP will tumble!

4) I have gone to a neighborhood Office Depot and I notice that there are not alot of customers that are flocking to buy products from the store. I get the feeling something is fishy with this company

5) The company has an extremely volatile history. You can expect more of the same to occur.
