The state legislatures have the power to appoint a slate of electors themselves, if they choose to. For much of our history, they did, until it was decided that tying the selection of electors to the popular ballot would be better. The Supreme Court deferred to the intent of the legislature to meet the safe harbor deadline. That was the Constitutionally correct decision. Liberal jurists just try to wiggle around it, because they do not like the provisions of the Constitution as written........
