As with other property transfers in exchange for money, the courts have found that NextWave owns the rights to use the spectrum and the government as a creditor can't just grab the property they supplied, which would damage other creditors.

You continue to amaze me Maurice. First of all, the court(s) did not confirm Nextwave's claims. Actually a number of court(S) confirmed the Govt. claims. Only one court affirmed Nextwave's claim. Second, There is NO PROPERTY involved here.. It is a license! A use license, IF all the terms of the grant of the license are met.

You know LICENSES.. Like those things that Qualcomm sell. Do you believe that if LU and MOT filed for Bankruptcy, that a court should allow MOT and LU to continue to use QCOM IPR to manufacture equipment and make money off of QCOM IPR even though the BK judge said that the LICENSE that QCOM sold them were now the property of LU or MOT. and that LU and MOT were free to use QCOM's license without paying a royalty?

Licenses have "Terms of Use". And Nextwave has violated one "terms of use" after another.

Senator Hollings has shown that our govt is not completely coruput. And has not allowed a group of "borderline criminals" to just walk away with the Property of the United States of America, without a fight.
