I agree that Emmanuel "Toto" Constant is suspected of many crimes.

Not suspected. He's been tried and convicted, certainly with more evidence than we have on Bin Laden. They are just waiting for extradition, for many years now. The U.S. won't release him because he will reveal a lot of crimes the CIA has committed, since he was on their payroll. It isn't surprising that the U.S. won't extradite him, but it is SHOCKING the way the U.S. media have blacked out the story. You don't have to like Chomsky's politics (he's too much of a commie for my taste), but he brings a lot of important, suppressed news items to the forefront.

That would have been a fruitless negotiation imho, trying to get OBL arrested.

All the more reason to enter into negotiations - that would have been further ammo in the court of public opinion. There really was no reason not to talk to the Taliban, since we had to build up our military anyway. But our leaders felt intense public pressure to appear strong-willed and vengeful, so talks went out the window.
