I believe that prohibtion on cruel and unusual punishment pertains to sentencing guidelines. The death penalty for shoplifting would be cruel and unusual, for the crime.

Criminals are not sentenced to the rack.

Torture is a means of gathering information. Since we do not torture criminals, we let them go in exchange for information. I oppose that, as well. On grounds that it violates the victims right to justice.

I think, and this is just my opinion, that once convicted, some kind of non invasive procedure could be used to extract information.

But, in order for me to favor that, I would need to believe that due process is being followed.
