John M. - I read all of the filing and did not notice a prohibition on shorting, but it could be there. I never thought that the prohibitions were enforceable anyway. What I did notice was Russian's mention of shorting as a possible/likely strategy (for D&F) in filings done at the time of the D&F buyout.

The need to do major financing really complicates the picture, I was caught off guard by the last, thinking (perhaps foolishly) that the good news (Enterprise release) would precede the deal. I made out fine in the end by adding significantly to my position after the deal and then cashing out this week after the big spike.

I am playing it again now looking for a move to $0.65 on first sales major results in February or March. The financing puts a lot of risk in this since another 25% discount will mow the grass again. There is at least some small chance that they can do the BEA thing with their VUI Enterprise platform; but it would be a big surprise. I am reasonably confident that the market will give it a spike or two regardless of the success of the product. This type of big-ticket product takes six months or more to show any reliable sales trends.

If they really have something, I would think they could do better than Hyperion, an absolute nobody. LT, a bleak and dark Wall Street undertaker in my view, was a big name compared to Hyperion.
