I listened to Company and a good part of the Q&A.

My concern was debt covenant, of which the company said there would be a violation question if it fails to meet lower 03 guidance. It said there is plenty of time for this to happen, enough time to make changes before it becomes an issue.

A second concern for me was the number of shares outstanding/being issued. It currently stands @ 515M shares, w/out adding possible conversion of the latest $200M convertible @ 6.5. Plus you have the s/holder lawsuit resolution coming the next 2 weeks, payable in cash, shares, or notes. The company has yet to decide, however it said it "will not be substentially above the number of shares" it had planned to give. The question arose since, now with a reduced price price ($3.07 @ 13.13 ET), more shares will have to be issued if the company decides to restitue with shares.
