Keith,

[L]et people figure it out for themselves by doing their own DD at the Sprint PCS store

And, let me guess, that you believe that people are capable of performing their own DD regarding investments?

There are truth in advertising laws on the books. While, I do not "perceive" that placing a "3G" label on that phone is "fraudulent", it could be considered a tad bit "deceptive".

In order to protect oneself, one always wants stipulations and exeptions in writing, not word of mouth.

By either removing the "3G" label, describing what the differences between that "3G" phone and future generations of "3G" phones in writing, or distinguishing the generation of "3G", might prevent future liabilities to both Sprint PCS and handset vendors.
