The "Festo decision" was a pretty controversial decision in IP Law. Festo attempts to limit patents based upon the events that take place during the prosecution of a patent.

For example, inventor comes up with idea. Inventor retains lawyer, lawyer drafts patent application...

Lawyer submits patent application.

This is where Festo applies, this is the prosecution:
Applicant(Inventor) and Lawyer receive Office Action back from teh USPTO. Action basically states that they have to "distinguish" their application over the "prior art". Or, in other words, their invention lacks patentablity.
