The reason Lindh is not being tried by a military court is that he is a United States citizen. So the Bill of Rights applies to him - unless it can be demonstrated that he renounced his US citizenship.

If Lindh renounced his US citizenship, then he could not be a traitor, right? Because the US would not be his country.

Ordinarily US military courts try people who are in the US military. The reason that the Al Qaeda members are being tried in US military courts is because the President recognized that this as a special situation.

We never recognized the Taliban as being the legitimate government of Afghanistan, but even if they were, Al Qaeda was never part of the Taliban. OBL is merely a warlord, and they are merely warriors - or thugs, if you'd rather.

Whatever international conventions would ordinarily apply to the soldiers of a foreign nation can't apply here because Al Qaeda never signed any of them.

We could just shoot them on the spot when they are captured, but that's not humane.
