I don't doubt that Intel is sampling faster frequencies. The health of the silicon is obviously very good. But Tom's Hardware did not use a 2.4GHz sample; rather, they just overclocked a 2.2GHz. The front side bus was a little overclocked, too, at 110MHz, but so was the Athlon's, so the comparison is at least close.
As for the second part, I'm sure that AMD will be fine with using more and more ridiculous model numbers to rate their processors. You can already see them abusing this system with their mobile 1500+ launch. Right now, they may have a slight advantage when it comes to model numbers over megahertz, but in the near future, this advantage will evaporate, and they will be left with chips that claim to perform better, but actually fail to deliver.
