LOS ALTOS, Calif.--(BW HealthWire)--Jan. 28, 2002--MoBeta, Inc. announced today that The Honorable M. Margaret McKeown, a Ninth Circuit Appellate Judge ordered Varian Medical Systems, Inc. (VAR) et al., to pay undisclosed costs to Mary E. Day, the President of MoBeta, Inc. following her successful appeal. The Federal Court Order, case no. 00-15059, filed on January 24th of this year, grants Day's ``opposed motion for taxation of costs'' and states that ``the taxation of costs on the mandate will be allowed to stand.'' Ms. Day was pleased with the decision. She was represented by Randall M. Widmann, Esq., a Palo Alto, CA attorney in private practice. Orrick, Herrington & Sutcliffe's Menlo Park, CA law partner Lynne Hermle, Esq. represented Varian in this US Court of Appeals loss.
