Any guy who has ever been in a fight can tell you that there comes a point (usually just as the fists start flying) when both parties just "lose it". This sounded like such a case, though I understand it was a reconfrontation of something that had started 20 minutes earlier..... The defendant was apparently not a brute who decided to pound people because he felt like it....but was just a guy who, like most guys at one time or another, got into a fight. The difference was that at a hockey rink, because people are walking around on skates all the time, they tend to have those hard concrete floors, and if you get the upper hand on somebody in that situation their head can snap back and hit the concrete and bad stuff results. The same force of punch might only have caused a black eye if delivered in a slightly different location....and the victim would still be alive and no charges would have been pressed.

Seems to me that having the defendant rot in prison for the rest of his kids' childhoods is not the best solution.....maybe some kind of indentured servitude on behalf of the family of the victim, and lots of community service thrown in....and making go on Oprah once or twice....would have been better for everybody.

P.S. I didn't see the trial. It sounds like the local judge's sentence may have been entered to pander to the public, in full knowledge that a three judge review panel will probably rein it back in to the four years that the guidelines suggest. That happens all the time when judges are elected (which I assume they are in Mass. though I don't know for sure).
