The real point is whether we ascribe to rule of law. Either these people come under guidance of international law such as the Geneva convention, or they can be prosecuted under U.S. criminal laws, or they are just subject to the whims of Rumsfeld and Bush. I don't like the rule of whim.

If these men are not soldiers it certainly calls into question whether the attack on Afganistan is a war, or an act of imperialism. This differs little from the kidnapping of Americans in the Philipines, except for the jumpsuits. Bad precidents are being set here.
