I don't believe we recognized the Taliban as the legitimate government of Afghanistan. Only a few countries did. Add their complicity with Al-Quaeda and their status becomes even more illegitimate. We did not attack Afghanistan, we sought the perpetrators of the 9-11 attack and their allies. As far as we were concerned the legitimate government of Afghanistan was on board and present circumstances bear this out, ....no imperialism there.

The rule of whim you state is military tribunals for illegal combatants, a class described as not covered under international law in the Geneva Convention. It is a course not without precedent. The bad precedent was flying planes full of civilians into a building occupied with civilians. Hard to see these civilians as illegal combatants.
