As near as I can tell, the administration line isn't (just) that they're not, by fiat, POWs, but that the Geneva Convention is , by fiat, inapplicable. Powell's dissent is that at least the procedures for determining who should be treated as POWs should be followed, but W apparently can't be bothered.

I don't think it would particularly harm US efforts to follow Geneva Convention protocol on the matter.
