EU Says Investigation of One Complaint Against Intel Continues

By James G. Neuger

Brussels, Feb. 4 (Bloomberg) -- The European Commission said it has yet to rule on one of two complaints that Intel Corp. abused its position as the biggest computer-chipmaker to discriminate against competitors.

One complaint has been withdrawn, said Michael Tscherny, a spokesman for Competition Commissioner Mario Monti. ``The investigation of the second complaint is at a very advanced stage, but no decision has been taken as yet,'' he said.

The commission, the 15-nation European Union's executive arm, opened the investigation in April after complaints Intel was using loyalty programs and rebates to prevent customers from going to competitors. The U.S. company's main rivals are Advanced Micro Devices Inc. and Taiwan's Via Technologies Inc.

Preliminary findings are that the second complaint is ``unfounded,'' commission spokeswoman Amelia Torres said Saturday.

Intel controls 84 percent of the European microprocessor market, which generated a quarter of the Santa Clara, California- based company's $34 billion in sales in 2000. Companies that break EU antitrust law face fines as high as 10 percent of sales.
