Dear Mr. Snyder:

This letter will acknowledge receipt of your letter and your objection to subpoena, both dated January 23, 2002.

You are correct that my client has not obtained a court order authorizing the subpoena in accordance with Doe v. 2TheMart.com Inc. Accordingly, the subpoena issued by my client on January 10, 2002, is hereby withdrawn.

Should my client decide to proceed further in this matter I will advice [sic] you of any steps which we take.
