When has any capitalist system, or any system, been the kind of shareholder democracy utopia you imagine? The fact is that the only people who control enough stock to force a change, the institutional shareholders, have not yet felt change was necessary. Don't get me wrong - I'm all for activist shareholders and directors. Hooray for Walter Hewlett.
BTW, the other facts are 1) we don't even know for sure that BAC is calling the loan and 2) we don't know for sure what the board would do if they did call it. So far, all is speculation about what the parties might do.
Again, I suggest that you, and others here, try to be less emotional and more rational about this. Stop reading The Street.com's sensationalized stories with headlines like "Bailing Out Bernie Will Bury Worldcom" and consider the financial realities of Worldcom and why Jim-Bob Cramer's headline is complete bullshit intended to grab attention for himself.
