Thorny issues raised here. Premies are put into incubators and routinely thrive and live. If a 7-month pregnant woman is murdered and the fetus doesn't survive, is it a single homicide or a double homicide? Does it depend upon whether the fetus is "viable," whether it is "wanted," or if it would have lived if it had been quickly placed in an incubator? What about a woman who is 6-1/2 months pregnant with a baby she wants, and somebody punches her in the stomach, causing a miscarriage? Murder? Yes, by some peoples' thinking, even liberals, but not according to other schools of thought. Many other fact patterns to consider, and somebody's going to have to come up with a a much more consistent and coherent view of how to deal with them. The theme liberals seem to focus on is whether the baby is wanted by the mother. But that won't work, because we can't base criminal murder laws on someone else's (other than the actor's) intent.
