The decision was impeccable. Seven justices agreed on the equity issue, the disagreement was over the remedy. However, Scalia and company are right: the Constitution gives the state legislature absolute power to determine the slate of electors, however it wants to, and therefore, having confirmed the slate and intending to meet the safe harbor, the intent of the legislature triumphs, and the recount, which could not meet the deadline, was preempted.
