Gentlemen:

Since this matter would appear to involve possible criminal charges against members of ENRON exec. team and its board, I would predict that if any criminal indictments result, then the Courts will most likely disallow any EP assertion.

If no criminal charges result then I think the Administration stands a better chance of successfully asserting the privilege but it is still not a sure bet.

Personally, I think it is a huge political mistake to withhold the documents requested. With the bar being as low as it is following the demise of the criminal enterprise formerly known as the Clinton/Gore Administration, I can't imagine anything would be found among those documents which would constitute an impeachable offense.
