That describes it well.

But your description of the Supreme Court decision ignores applying these laws of the "public commons". Just like the townhall debate you can see the problem that can occur. Those bringing a sufficiently large megaphone shout down others and limit debate.

The other big danger is the limitation of media outlets and editorial diversity by concentration of ownership, which effectively compounds the "shouting down" problem of the bigger-megaphone media buys, with a different problem of screening of news stories and opinion.

For some issues, the same "big megaphone" folks who shout down dissenters inside the hall can also be media owners who can shut the doors to keep others out.
