There may have been some arrogance and their certainly was some stubbornness involved but the idea wasn't that we were above the Geneva convention as much as it was that the detainees were not covered by it. You could make a case that the Taliban is not covered by it and it seems obvious that at least Al-Qaida is not covered by it, but it might be like Cheny's claim that he doesn't have to reveal who he talked to. Even if his is in the right and even if he wins in court he could lose politically.

The question I have about considering the Taliban to be prisoners of war under the Geneva Convention is that we might be required to let them go. (I don't think we actually will whatever the convention requires) POWs are supposed to be let go when hostilities end. We are still fighting, but the Taliban was an Afghanistan thing. If we ever stabilize Afghanistan and root out the terrorist presence that is left over there then it could be argued that the Taliban prisoners have to be sent home.

But I'm not sure if prisoners have to be released when only one part of an alliance is defeated. Did we have to free German POWs before Japan surrendered? Also it could be argued that the Taliban and Al-Qaida are so closely intertwined that we are still at war with both as long as we are at war with one.
