That's perfectly legal. To prevent this place all-or-none (AON) order meaning they will either execute all contracts or none.

I had this situation with them once and insisted that I suffered 'cause they didn't have an AON option. So they credited my account for $29.

However, I left E*Trade soon after that. My present broker, Regal, always executes the size I put in my order (I trade up to 30 contracts sometimes). The trick is that if you put AON order, the priority will go to non-AON orders (assuming you placed a limit order), so you'll always be behind.

It pays to trade with live broker. Especially if commissions are the same as E*Trade's. Check out their homepage at

E*Trade just sucks. The worst and the slowest broker of all.
