I agree that the FDA is not to blame here. But they DID approve the trial without a placebo control group. So the 'only' thing that IMCL didn't do is prove that the patients were unresponsive to chemo. If IMCL can indeed 'prove' this with existing info not previously provided, why wouldn't they get approval?

And I wouldn't put it past Icahn and the Waksal's to put together some stunt to try to move the stock up or to pick it up even cheaper (single digits) if FDA says new trials are required in order to negotiate with BMY from a stronger position.
