this is an odd bit of the story:

"While not on the IOC's list of banned substances, darbepoetin is commonly used for the treatment of anaemia. It stimulates the production of red blood cells, which help carry oxygen."

I remember carrying around my book of banned substances, always checking cold medicines before purchasing. I assume that they will be able to apply the malicious intent rule on this that darbepoetin is not readily available and therefore was taken knowingly to enhance performance. That ruling always weighed over the "not a banned substance" defense back in the 90's.
