Nobody makes federal laws except Congress. Hence there is no way that the Federal Government can address religion one way or the other, thus separation of church and state. I'm not a constitutional lawyer, but my take is that states, municipalities, or any other authority are not allowed to pass laws (or institute policy) counter to what is specifically addressed by the US Constitution. Hence it's a no-no all the way down the line.
