I looked at S.1940, and apart from some of the nastier ramifications, I find it to be a very ambiguous and poorly written bill at this point. No distinction is made (at least in the current bill) between ISO and Non-qual stock options. It doesn't make a lot of sense to discuss transfer of property in regards to non-qual stock options because the employees will count those as income (wages) as opposed to capital gains on their personal income tax...
