Which is a fancy way of saying that there is more ritual involved in killing a prisoner for crimes than there is for killing a group of villagers for perceived threats to the state. Understanding a complex topic can be compared to climbing a mountain. You cannot just just go straight to the top but must twist and turn on pathways that may lead to dead ends and may require extraordinary effort. Ritual defines a pathway. It could lead you to the top, or it could lead to an insurmountable cliff. In this case I think the ritual of prosecuter rewards for harse results, and the exclusion of death penalty opponents from juries, and convoluted appeals that do not allow reconsidering guilt but only technical procedures is designed to lead to a cliff of non-understanding. Those who do not examine the arguments, but merely repeat them will remain at the cliff base.

(Or if you want the short answer, the difference between our state killing of opponents and Saddam's state killing of opponents is more about procedure designed to hide blame than anything else)
