Why in the world should drug companies have to prove effectiveness "beyond a reasonable doubt?" That is an extremely high standard - it is used in the criminal law simply because of our great desire not to punish an innocent man. But in civil cases, the standard is simply: "more likely than not." I think the standard of proof of effectiveness of a drug should simply be that it is more likely to be effective, than not. That is the standard whereby millions, and billions, of dollars are ordered paid by one party to another in civil trials. I think it should be a sufficient standard for drug effectiveness.
