IMO, the analogy with a criminal trial is erroneous for the reasons that you state. However, in science the standard is whether the null hypothesis--there is no effect--can be rejected. The accepted standard is a variety of probability based statistics that require that the found effect could occur by chance one out of 20 times. Given the huge costs of drugs and the false hopes that a cure promises, I don't think that unreasonable. Remember, if there is an effect, good experimental design and careful documentation should be able to demonstrate it.

In my experience, however, it is difficult for a humane oncologist to tell a sick pt. that s/he isn't sick enough. e.g., refractory, and can't participate in the clinical trial. Therein lies the rub...
