The Supremes will sing in '03, and will rule on the issue of whether the FCC has the authority to take back spectrum NW had won in the auction when a BK is pending or whether the FCC has to act like any other creditor and be bound by the protective provisions of the BK Code.. That's the narrow issue and that is probably the narrow point on which the Court will rule.

There is an esoteric jurisdictional issue present in the case but I don't think it will matter. However, that issue does have the potential for delaying things beyond '03 should the Supremes focus on it, which I think is unlikely.
