the problem was that the D.C. Circuit should have enjoined the FCC from reauctioning in the first place and should never relied on the FCC's promise to honor the court's decision. All it did was muck up the works even more, and it created interested lobbyists against NextWave in the spectrum bidders. The FCC, as usual, has fouled up everything. We will end up with a theoretical opinion on pointy-headed legal issues and even if the Circuit Court is reversed, it may well be remanded.
