I think there are some things to consider. (a) The article points out that damages must be reasonablely forseeable; even if some damage was forseeable, that doesn't mean the amounts which are being asked for were forseeable. With hundreds of thrifts lining up, I think courts will be reluctant to grant each of them roughly a billion in damages. (b) if there is a settlement it will be for significantly less than what is being asked for, perhaps half to a quarter. I say this not to criticize, but because I am trying myself to determine the proper buying point.
