1. Says who?
2. Sunw can project actual data on how much money they are going to lose by have MSFT not include Java in the XP operating system. It is quanitiable so a number can be established mathematically by how much server and storage sales were lost as a result.
3. I think these private lawsuits have a good chance of winning in the courts because msft has alread been convicted of abusing monopoly power. The precedent has been established and this is just another example how msft continues to abuse their monopoly power. Once you are legally considered a monopoly you have to change your behavior. MSFT management is having a hard time with this because they are soo aggessive.
