What was most disturbing in reading the Petition for Certiarare of the FCC is the interpretation that Congress in its statute providing for auction of spectrum chose to create "efficient and effective" use of spectrum solely by the auction price. The FCC, in effect, says it cannot mandate or require carriers to choose more efficient platforms. What that, of course, does is allow the established players with cash hoards to buy their way through the system on inefficient platforms.
